Anti-Money Laundering (AML)
Speak with an expertWho Must Comply with AML Regulations?
UAE AML regulations apply to Financial Institutions (banks, exchanges, investment firms) and Designated Non-Financial Businesses and Professions (DNFBPs). DNFBPs are specific non-financial sectors that are considered vulnerable to money laundering and terrorist financing.
You are classified as a DNFBP and subject to strict AML compliance if your business activity falls into one of the following categories:
Real Estate Brokers & Agents: When involved in transactions concerning the buying or selling of real estate.
Dealers in Precious Metals and Stones: When engaging in single or multiple linked cash transactions of AED 55,000 or more.
Lawyers, Notaries, and Independent Legal Professionals: When assisting clients in specific transactions (e.g., buying real estate, managing client funds, creating companies).
Independent Accountants and Auditors: When providing accounting, audit, or tax services.
Corporate Service Providers: Businesses (like AB Nexis) that act as formation agents, provide directors or registered offices, or arrange nominee shareholders.
Key AML Obligations for DNFBPs
If your business is a DNFBP, you are legally required to implement the following measures:
1. Appoint a Compliance Officer
Designate a qualified AML/CFT Compliance Officer responsible for managing the compliance programme and reporting to senior management and authorities.
2. Register on goAML
Register your business on the Financial Intelligence Unit's (FIU) goAML portal to enable the filing of Suspicious Transaction Reports (STRs) and other regulatory reports.
3. Conduct an Enterprise Risk Assessment
Identify, assess, and understand the money laundering and terrorist financing risks specific to your business, customers, products, and geographic footprint.
4. Develop AML Policies & Procedures
Create and implement a comprehensive AML/CFT policy manual outlining your internal controls, customer due diligence processes, and reporting mechanisms.
